Terms And Conditions

By posting goods to Gold Seller’s Friend, each seller agrees to all the T's and C's

 

Every seller must be at least 18 years of age in order to sell items to Gold Seller’s Friend. Every seller must be the actual legal owner of all gold, jewelry and other property sold or attempted to be sold to Gold Seller’s Friend. Every seller must be acting on his or her own behalf and not as the agent or representative of another person.

 

At Gold Seller’s Friend's request, the seller will provide documentation or other proof that complies with the requirements contained in these T's and C's.

 

The seller guarantees all of the following: that no items sent to us are the result of illegal activity in the UK or any other country; that any transaction initiated by the seller will not cause Gold Seller’s Friend to be in violation of any anti-money laundering, anti-terrorism, or other applicable law of any country; not to send any hazardous material to Gold Seller’s Friend and not to send Gold Seller’s Friend any material that does not contain precious metals.

 

Posting and Insurance

All items posted to us are at the seller's own risk (albeit they are insured by Royal Mail for up to £750 until we receive them) until received and signed for by Gold Seller’s Friend. If you believe your items are worth more than £750, you must pay an additional fee at the Post Office to increase the insurance level to either £1,000 or £2,500. If, for any reason, Gold Seller’s Friend does not buy your items, then no refund will be made against any extra insurance you may have taken out.

 

Any such packages we reject will be returned to you - at our cost - but without any liability to Gold Seller’s Friend.

 

Gemstones

Gold Seller’s Friend accepts Gemstones. Generally it may cost more to remove a Gemstone from its setting than its value to us, so they have no intrinsic value.

 

Valuation and Offer

Once your items have been received they may be tested by our specially trained experts to determine their value, based on that day's precious metal markets. By sending us your jewelry you accept that this process of determining a value may involve placing certain acids on the gold, silver, platinum or other items which can leave permanent staining and/or deep scratches. Gold Seller’s Friend.com is not liable for any damage caused in this way or any resulting decrease in the value of the items. If we buy your items, this becomes irrelevant anyway.

 

We will try to make contact with you by phone. If we fail to make contact initially, we will keep trying and will keep your goods in a secure place such as a safe, in the meantime. When we make you an offer, it will be valid until 5 pm that same day - as the price of Gold and other precious metals change regularly, our offers cannot be extended beyond then. Once you have accepted our offer, the goods can be immediately shipped for melting down so your acceptance is legally binding on both of us and it is irrevocable. Please note that when accepting an offer, any no value items will not be automatically returned unless specifically requested at the time of the offer.

 

If after 28 days we have been unable to contact you - we will email you payment by Paypal to the email address you gave on when filling out your request for a gold pack. If you do not want to accept the offer, you have 14 days to decline our offer either by phone or email and your items will be returned to you. If you have not declined within this time, we will assume the offer has been accepted and the items will then be shipped for refining even if the Paypal payment has not been drawn down.

 

How do sellers get paid?

After our offer has been accepted, we will pay you by faster payment directly into your bank account. We will ask you to confirm your details at the time of receiving the offer.

Payments and Returned Items

Nearly all our sellers accept the offer we make them, but if you decide not to accept our offer for your items, your goods will be returned to you - at our cost, within five (5) working days from when you declined our offer.

However, if you only send items containing no precious metals, there is a £15 fee for returning them, or we can dispose of them free of charge. Your payment must be received within 28 days or the items will be disposed of.

If returned items are not able to be delivered by the Royal Mail because they have been unable to obtain a signature, they will leave an instruction card. If the package is returned to local delivery office, it will need to be collected within a period of time specified by the Royal Mail. If, however, the package is not collected within this time, it will be returned to us.

On receipt of the returned items, we will contact you to arrange for the items to be resent; however, there will be a charge of £10 to cover the additional postage and administration costs.

For returned items that have been sent back to us because they have not been collected after delivery has been attempted - Payment must be received within 21 days of contacting you or we reserve the right to purchase the items at our current gold price with a deduction of £20 for our administration costs and storage.

 

Return/Loss Liabilities

In the unlikely event that any of your items are lost once we have received them, Gold Seller’s Friend will pay you their replacement value, or provide items of a near equivalent value. If you are not happy with the near equivalent items we provide, we will jointly appoint, and jointly pay for, an independent valuer to assess them and we will both be bound by his or her judgment.

 

When returning your original items, Gold Seller’s Friend shall, in its own discretion, choose the return carrier and relevant insurance for each such return. Gold Seller’s Friend is not liable for any items becoming lost or damaged in transit. If items are lost or damaged Gold Seller’s Friend will provide all relevant documentation required in order to make a claim from the carrier for the replacement or repair of the lost or damaged items. The seller also agrees to provide all such information as we or the return carriers' Insurance company may reasonably request in order to successfully process the claim.

 

Lost Property

If items are sent to us without a completed seller form it is unlikely we will be able to identify the sender unless the name and address has been written on the Special Delivery envelope. If the pack was requested via our website we may be able to identify the sender using the special delivery reference number.  If, however, we are not able to identify the sender then the items will be classed as lost property.

 

We will continue to hold these items for a period of 6 months in a secure area. Sellers claiming items will be required to provide a full and detailed description before an offer is made. Once we have confirmed a successful lost property claim, we will make payment for the items at our current price.  If the items have been held in excess of 3-months, a deduction will be made from this payment to cover our storage and administration costs.

 

If a claim is not made within 6 months the items will be refined to recover our storage and insurance costs. If a claim is made after the items have been refined, a payment will be made for any outstanding amount due at our standard gold buying price on the day it was refined.

 

Items sent in Error (not intended for us)

Our Special Delivery envelopes are coded with a unique license and are for sellers sending precious metal with the intent to sell. If you use our Special Delivery envelope to send items intended for someone else - they will be sent to us. The fee for returning these items is £20, this covers the postage, insurance and administration costs.

Claims

A seller who wishes to submit a claim to Gold Seller’s Friend must notify Gold Seller’s Friend immediately to request a claim form. In order to be processed, the claim form must be fully and accurately completed, signed, and posted to Gold Seller’s Friend, in accordance with the claim form instructions. The seller must submit any and all supporting documentation with the completed and signed form. Failure to properly complete, sign and post the claim form may result in the denial of the claim by Gold Seller’s Friend. There is a 14 day processing period from the time the claim form is received by Gold Seller’s Friend and the claim is processed. Your statutory rights remain unaffected.

 

All phone calls between Gold Seller’s Friend and its sellers or potential sellers may be recorded for security and training purposes. Any such recording may be relied upon by Gold Seller’s Friend in the event of any dispute.

 

Legal Information

This Agreement shall be governed by the laws of England and Wales

 

Gold Seller’s Friend's failure to exercise or enforce any right or provision of these T's and C's will not be deemed to be a waiver of such right or provision. If any provision is found by a court of competent jurisdiction to be invalid, the parties nevertheless agree that the court shall endeavour to give effect to the parties' intentions as reflected in the provision and the other provisions of these T's and C's will remain in full force and effect. Sellers agree that regardless of any statute or law to the contrary, any claim or cause of action arising out of or related to use of the services offered by Gold Seller’s Friend must be filed within one (1) year after such claim or cause of action arose. Any such claim or cause of action must be filed in the UK.

 

You agree to indemnify and hold harmless Gold Seller’s Friend against any and all liability, claims, suits, losses, costs and legal fees caused by, arising out of, or resulting from any breach or claimed breach by you of these T's and C's, including claims brought by third parties.

 

Gold Seller’s Friend reserves the right to change these T's and C's and advise you to revisit our website, at www.Gold-Sellers-Friend.com, periodically to ensure that you are aware of our current T's and C's. If a seller sends items more than once, it is your responsibility to check the T's and C's on each separate occasion that you choose to send us gold or jewellery items to ensure you know our latest T's and C's by which you agree to be bound by sending those subsequent items to us.

 

Gold Seller’s Friend complies with all requirements of the Data Protection Act. Your information will only be used if you have given us permission to do so. Any bank account or similar details you provide will be treated confidentially and will only be stored subject to high security methods and only if we have your permission in advance.

 

Gold Seller’s Friend is a UK business and only accepts gold from UK addresses and only pays to UK accounts.
